Terms & Conditions Agreement
PACKAGE PRICES: All prices are in USD and are subject to change due to currency fluctuation and changes in duties, taxes, and government levies. Single-golfer supplemental rates are available on request or as posted.
DEPOSIT / PAYMENTS: A non-refundable deposit is required when reservations are requested. Visa, MasterCard, Amex, Discover, Paypal, wire transfer, and check are acceptable payment methods. All guests must provide authorization, acknowledging purchase and acceptance of Terms and Conditions.
Domestic Golf Packages
Individual – A $1500 non-refundable deposit is due for domestic U.S. golf packages at the time reservations are requested. All subsequent payments are non-refundable and due based upon the schedule posted for each trip.
Groups – A 25% or $1500, whichever is greater, non-refundable deposit is due for domestic U.S. golf packages at the time reservations are requested. All subsequent payments are non-refundable and due based upon the posted payment schedule per trip.
International Golf Packages
Individual – $2500.00 non-refundable deposit is due for international reservations. All subsequent, non-refundable payments are due based upon the posted payment plan per each trip.
Groups – A 25% or $1500.00, whichever is greater, non-refundable deposit per person is due for international golf packages at the time reservations are requested. All subsequent and final payments are non-refundable and are due based upon the posted payment plan per each trip.Full payment may be specified dependent upon contractual agreement with resort.
Note: Specific deposit, payment, and cancellation policies may differ according to vendor and venue. Specific payment and cancellation policies may apply to group/event packages. Consult your WGTC travel specialist for details. Tournament event, such as the Solheim Cup and Ryder Cup, payments are non-refundable.
CANCELLATIONS: A cancellation request must be submitted in writing to WGTC. We understand circumstances arise and will gladly refund payments less a $300 processing fee upon the condition that a like-reservation is identified and based upon availability of accomodations at the time of cancellations.
Please note: When one member of a party cancels a group trip, it may affect the total package price for the remaining members.
Domestic: Your responsibility is to inquire about the course policy regarding rain or bad weather. You must call the individual course directly to verify if the course is closed BEFORE redeeming a golf credit . Once credits have been submitted to the course for play, WGTC cannot issue a refund. If the course is officially closed due to inclement weather, it is your responsibility to call our office to let us know and then have the certificate signed by the Golf Professional or other member of the golf course staff indicating that the course is closed. You must then return the original voucher to our office within ten days of your trip to obtain a rain refund (if applicable – individual course policy will dictate any refunds due). WGTC does not issue rain check refunds for future play. The course will often issue a “rain check” if you cannot complete your round due to rain.
International: Golf courses at international destinations are not known to close their course due to inclement weather. We strongly advise that you bring rain gear with you and be prepared to play in all weather conditions. Refunds and or rain checks are not given for unplayed rounds of golf.
ADVISEMENT BY GOLF TOUR OPERATOR: WGTC warrants that each client has been provided with and advised to review a copy of the foregoing Terms and Conditions carefully and that the customer fully understands that he/she is subject to said requirements and policies.
ENTRY REQUIREMENTS: Passports are required for U.S. citizens when traveling to most international destinations. Passports should be valid for six months upon entry into the country. Visas may also be necessary for some destinations; please enquire for more information.
TRAVEL DOCUMENTS: Travel documents will be delivered at least 14 days before departure for domestic travel and 21 days before international travel. Under no circumstances will WGTC release documents without full payment.
AIR TRAVEL: Air travel is not included in your Golf Package(s). Air travel and transportation to your destination are your own responsibility.
LOST TICKETS / VOUCHERS: WGTC assumes no liability for lost or stolen event tickets/vouchers. If required, a replacement set of event tickets/vouchers will be sent via overnight mail for a charge of $25.00 per delivery.
(to U.S. addresses only). The passenger is responsible for any cost associated with the subsequent use of lost or stolen vouchers.
LATE BOOKINGS: We will make every effort to accommodate reservations booked on short notice. However, bookings made less than 14 days before arrival will result in a late booking charge of $25.00 per tour (Individuals) or $50.00 per person (Groups), which includes overnight delivery of travel documents.
RESPONSIBILITY: WGTC, based in Charlotte, North Carolina, acts solely as an independent contractor licensee and not as an agent, employee, partner, or joint venture of any entity.
RELEASE OF LIABILITY: WGTC acts on behalf of the customer and is not liable for any losses or breaches of contract or any omissions or careless actions on the part of suppliers that may result in any damage, loss, injury, or irregularity to any customer for tours arranged by WGTC. In the absence of gross negligence on their part, WGTC shall not be responsible or liable for any personal injury or property damage, delayed departure, missed carrier connections, lost or damaged luggage, the substitution of service, changes in fares, schedules, or rates by any transportation carrier, hotel, resort or golf course, cancellation, double booking, missed reservations or lost tickets beyond its control. Furthermore, WGTC is not now and shall not become liable or responsible in any way whatsoever for any loss, injury, epidemics, or damage caused by acts of God, acts of government or other entities, wars, civil disturbances, hijacks, thefts, or any other circumstances beyond its control.
Tour participants should note that the suppliers/vendors providing accommodations or services are independent contractors, not agents or employees of WGTC. WGTC has the right to alter the printed itinerary, brochure prices, and package features without notice and shall not be responsible for any inconvenience or expense occasioned by such changes.
By embarking on his/her travel, the customer acknowledges these terms and voluntarily assumes all risks. All rates contained in this proposal are valid at the time presented but are subject to change at any time. The tour participant, individually and on behalf of the individual’s heirs, spouse and beneficiaries, expressly waive any claims of any nature or descriptions against WGTC arising from, or in any way attributable to, golf packages in conjunction with WGTC golf vacation programs.
INSURANCE: You are responsible for, and we strongly recommend, you obtain travel insurance to protect yourself to the extent possible. We do not carry and have no obligation to carry insurance coverage to protect you. We are not insurance agents and can not sell such policies and only provide recommendations to purchase such and protect the investment in your travel package.
ENTIRE CONTRACT: This is the complete, final, and exclusive binding contract between the parties relating to travel and supersedes all prior agreements, and understandings, both written and oral, and may not be amended or altered after your initial deposit has been made except in writing, signed by all parties.
SEVERABILITY: If any provision or portion of any provision is held unenforceable or invalid, the validity and enforceability of the enforceable portion of any such provisions shall not be affected.
NOTICES: All notices and communications shall be in writing and shall be mailed first class, faxed, or emailed as follows:
- If intended for us, address to WGTC c/c Barbara Gutstadt 2121 Delpond Lane, Charlotte, NC, 28226. Email: Barbara@WomensGolfandTravel.com or another address we may have designated in writing to you.
- If intended for you, at the address provided by you on booking or to such other address as may be designated by you in writing to us.
All notices, requests, consents, waivers, approvals, demands, and communications required or permitted under the agreement must be in writing. They shall be deemed to have been duly given upon earliest to occur of (a) when delivered personally by hand to the recipient, (b) when delivered by overnight courier (such as FedEx or UPS), (c) when transmitted by electronic mail with the receipt of such electronic mail being confirmed by telephone, or (d) via first class mail, no later than the business day following the transmission.
CAPTIONS: Captions are for convenience and reference only and shall not constitute a part of this contract or be given any substantive effect.
CONFIDENTIALITY: All information regarding the terms of this Agreement and any Addendum(s) shall be kept confidential. No confidential information of either party shall be disclosed to other parties without the other party’s written consent.
INDEMNIFICATION: To the fullest extent permitted by law, each of the parties shall indemnify, defend and hold the other party (and its respective officers, directors, employees, agents, members, affiliates, and subsidiaries) harmless from and against all claims, damages, losses, and expenses, whether direct, indirect or consequential, including but not limited to all fees and charges of attorneys, court and arbitration costs (whether incurred in preparation for trial or arbitration, at trial or arbitration or on appeal in insolvency proceedings incurred by the indemnitee) as a result of or relating to a breach of any provision of this Agreement by the Indemnitor unless the indemnitee has explicitly approved the act or omission. This provision shall survive the duration of this Agreement.
GOVERNING LAW, DISPUTES, AND ARBITRATION: This contract shall be governed by and construed in accordance with the laws of the state of North Carolina, USA. Any dispute, controversy, claim, or complaint between the parties must be resolved by final and binding arbitration in accordance with the International Arbitration Rules of the American Arbitration Association through its North Carolina Regional Office unless the parties mutually agree otherwise in writing.
Reserving a package and sending the initial deposit is and shall constitute the acceptance and ratification of this contract by you.
EVENT OCCURRENCE AND FORCE MAJEURE: We provide hotel reservations, ground transportation, and all services from third parties as a golf tour operator and not as a principal. If the planned event is postponed, canceled, or relocated due to disaster, government action, acts of God, strikes or labor unrest (other than by our employees), riot or civil disorder, acts of terrorism, inclement weather, transportation strike, or another event beyond our control not anticipated or known by either you or by us at the time of the purchase of your package(s), our liability, if any, is and shall be limited to providing you with replacement hotel reservations and ground transfers to the next or rescheduled event, with price escalation and adjustment as necessitated by change of date(s). We shall have no other and further liability to you. Likewise, if we arrange air travel or golf tee times, we shall have no liability to you should the event not occur when and where scheduled, and you choose not to use such purchased services.
By registering for a trip, you acknowledge that you have reviewed and accepted the terms and conditions of booking a trip with Women’s Golf and Travel.
