TRAVEL WAIVER, RELEASE, AND INDEMNIFICATION AGREEMENT
In consideration, and as a condition of my participation in a golf tour being organized and hosted by Women’s Golf and Travel Concierge (WGTC) / Barbara Gutstadt, herein referred to as the “Releasees’” and the undersigned (“Traveling Guest”), agrees to be bound by the following conditions, terms and release, whether the activity is golf-related, social or both in nature.
Assumption of Risk and Responsibility.
Traveling Guest acknowledges that golf is a sport requiring physical exertion and may involve other individuals, motorized vehicles, golf carts, golf clubs, golf balls and other unknown, unanticipated, or unpredicted risks and/or hazards, including exposure to a virus or other communicable diseases such as SARS-CoV-2 coronavirus that causes the COVID-19 virus (“COVID-19”), and that the Traveling Guest may be exposed to the risks of serious injury, permanent disability, or even death (“Golf Tour Injuries”). Traveling Guest acknowledges that participating as a Traveling Guest is voluntary and that Traveling Guest is fully aware of, and assumes these risks.
If a Traveling Guest is playing golf or touring a Destination or at a Golf School, the Traveling Guest acknowledges that she/he is in adequate physical condition and fully capable of playing a game of golf and participating in the offered excursions. All Traveling Guests acknowledge that they are in the adequate physical condition and fully capable of undertaking any tasks that the Traveling Guest chooses to perform. Traveling Guest recognizes that WGTC is not responsible for any lack of guidance or training in the sport or rules of golf and/or the golf course being played by Traveling Guest, nor can it control the conditions of the golf course; the conduct of other individuals playing at the golf course, or employees/staff on the golf course, or any other individuals (including other Traveling Guests) or uninvited guests; or otherwise reduce any risk to which Traveling Guest may be subject during any time period Traveling Guest is taking part in the Golf Tour.
Agreement Regarding COVID.
Without limiting the foregoing, Traveling Guest acknowledges the contagious and harmful nature of the COVID- 19 and knowingly and voluntarily assumes the risk that Traveling Guest may be exposed to or infected by COVID-19 by participating in the Golf Tour. Traveling Guest agrees that Traveling Guest could be subject to frequent temperature checks and verbal and/or written questionnaires and will be expected to practice social distancing and good personal hygiene, including wearing masks if mandated, at all times (“Protective Measures”).
Traveling Guest attests to have read and will abide by the CDC’s recommendations regarding the spread of COVID-19 at: https://www.cdc.gov/coronavirus/2023/.
Traveling Guests will certify that before traveling will not be infected with COVID-19, will not be experiencing symptoms that may be associated with COVID-19, and within the past 14 days before traveling, will not have been in close contact with anyone infected with COVID-19.
Release of Claims, Covenant Not to Sue, and Indemnification.
Traveling Guest ASSUMES ALL RISK AND DANGER SURROUNDING AND ASSOCIATED WITH Traveling Guest’s PARTICIPATION IN THE GOLF TOUR AND RELATED ACTIVITIES ORGANIZED AND SPONSORED BY WOMEN’S GOLF AND TRAVEL. Traveling Guest, Traveling Guest’s personal representatives and administrators, heirs, and next of kin hereby waive, release, covenant not to sue, and forever discharge Releasees in its entirety, including but not limited to officers, employees, ambassadors, consultants, all sponsors and/or third parties involved in the Golf Tour, and each of their respective affiliates, officers, directors, employees, volunteers, sponsors, workers, members and agents (collectively, “Releasees”) from and against any and all injuries, losses, damages, claims, actions, and any liability of any kind (including, without limitation, personal injury, death, or loss or damage to personal, private, or other property) (“Claims”), whether caused by the negligence of Releasees or otherwise, as a result of or in connection with Traveling Guest’s participation in and/or presence at the Golf Tour. Traveling Guest further agrees to indemnify, defend and hold harmless the Releasees for any liability, demand, judgment, claim or suit, including reasonable costs and attorney fees, arising out of or in connection with Traveling Guest’s acts or omissions or allegations thereof as a Traveling Guest on the Golf Tour. Traveling Guest will be responsible for Traveling Guest’s personal belongings and equipment and will not hold WGTC / Barbara Gutstadt
responsible for their loss. Traveling Guests will treat the facilities and equipment provided in connection with the Golf Tour with care. Traveling Guest understands Traveling Guest will be assessed for any damage to facilities or equipment caused by Traveling Guest’s acts or omissions.
Agreement to Follow Rules, Policies, and Procedures.
Traveling Guest acknowledges that WGTC / Barbara Gutstadt may implement and enforce rules, policies, and procedures in connection with the Golf Tour, including without limitation, to ensure appropriate conduct by Traveling Guests and to implement and comply with public health and safety requirements, guidelines, and/or recommendations, whether relating to the COVID-19 virus or otherwise (collectively “Golf Tour Rules”).
Traveling Guest agrees to comply with all such Golf Tour Rules. It agrees that if Traveling Guest fails to comply with any Golf Tour Rules or commits any misconduct, or if Traveling Guest’s participation might pose any health risk to others, all as determined by WGTC / Barbara Gutatadt in its sole discretion, WGTC / Barbara Gutstadt may refuse to allow Traveling Guest to participate in the Golf Tour, without any refund to Traveling Guest or any liability to WGTC / Barbara Gutstadt.
Media Rights/Likeness. Traveling Guest hereby grants permission throughout the universe in perpetuity to WGTC / Barbara Gutstadt to utilize Traveling Guest’s likeness, image, voice, and/or words incidental to any pictures, television, radio, videotapes, recordings, film, the Internet, or any other form or medium now known or hereinafter devised without compensation, payment of royalties, notification, or permission.
Traveling Guest further understands and irrevocably agrees that (i) these materials will become the property of WGTC / Barbara Giystadt and will not be returned to Traveling Guest; (ii) Releasees may edit, alter, copy, exhibit, publish or distribute photos for purposes of publicizing or promoting Releasees, their programs, or for any other lawful purpose; and (iii) Traveling Guest waives any right to inspect or approve Releasees’ use of Traveling Guest’s likeness, image, voice, and/or words.
First Aid. While on the Golf Tour, if Traveling Guest is unable to do so on Traveling Guest’s own because of injury or illness, the Traveling Guest consents to administration of first aid and/or medical treatment and agrees to indemnify, waive, release, covenant not to sue, and forever discharge Releasees’ from any and all liability or claims arising out of such treatment.
Traveling Guest acknowledges that the terms of this document may be modified at any time to impose new or additional terms or conditions related to participation in the Golf Tour. Such modifications and additional terms and conditions will be effective immediately, and Traveling Guest’s continued participation in the Golf Tour will be deemed acceptance thereof. Traveling Guest agrees that North Carolina law shall govern any and all disputes arising in connection with participation in the Golf Tour, receipt of services described in connection in addition to that, and disputes involving Releasees. Such disputes shall be resolved by arbitration in the State of North Carolina pursuant to the Commercial Rules of the American Arbitration Association then in force. A judgment upon the award rendered by the arbitrators shall be final and non-appealable and may be entered in any court having jurisdiction thereof.
Traveling Guest affirms that Traveling Guest has read and understands this Golf Tour Waiver, Release and Indemnification Agreement and that Traveling Guest has executed this document freely and voluntarily, and entirely upon Traveling Guest’s own initiative, and intends to assume all risk and responsibility for Traveling Guest’s actions and further agrees to sign the same willingly and accept its terms and conditions.

Terms & Conditions Agreement

BROCHURE PRICES: All prices are in USD and are subject to change due to currency fluctuation and changes in duties, taxes, and government levies. Single golfer supplemental may apply.
DEPOSIT/PAYMENT: A non-refundable deposit is required when reservations are requested. Visa, MasterCard, Amex, Discover, and check may make payments.
Domestic Golf Packages
Individual – A $1500 non-refundable deposit is due for domestic U.S. golf packages when reservations are requested unless otherwise specified. The final payment is due 90 days before departure.
Groups – A 25% non-refundable deposit per person is due for domestic U.S. golf packages when reservations are requested unless otherwise specified. The final payment is due 90 days before departure unless otherwise stated.
International Golf Packages
Individual – $2000.00 non-refundable deposit unless otherwise specified. Full payment is due 90 days before departure unless otherwise stated.
Groups – A 25% or $2500.00, whichever is greater, non-refundable deposit per person is due for international golf packages at the time reservations are requested unless otherwise specified. The final payment is due 60 days before departure unless otherwise stated.
Tournaments, Special Events, Group Travel Specific deposits, payment schedules, and cancellation policies may differ according to the venue. Deposits are non-refundable due to the nature of the forum and third-party vendors requiring funds to reserve hotel reservations, tee times, etc., for a specific date (s) and a number of guests.
CANCELLATIONS: All cancellations must be submitted in writing to WGTC and are subject to the following per-person cancellation charges:
Domestic / International Group Destinations – Deposits and payments are non-refundable unless a replacement guest has been identified and the new guest has made a deposit and payments. When one party member cancels, it may affect the total package price for the remaining members.
Tournaments / Special Events – Special venues and tournaments deposits and payments are non-refundable unless you can identify a replacement. Upon the amount of a new promise and charges being made equivalent to what the canceled guest has completed, you will receive a full refund.
Group Travel – Deposits are non-refundable. If the group trip is canceled due to the minimum number of guests not meeting the required amount, all guests will receive their total deposits within 30 days of notice by WGTC.
We understand things come up that can affect your travel. All cancellations must be submitted in writing to WGTC and are subject to the following terms: A replacement guest, fully registered and paid up to date, is required to receive a refund, less a processing fee of $75.00.
Please note: When one guest of a party cancels, it may affect the remaining guests’ total package price and the cost of the package in a double occupancy situation.
CHANGES: Any customer-initiated changes (dates, names, courses, tee times, etc.) requested after the time of booking may result in a change fee plus any applicable increase in price.
Individual – Domestic U.S. packages: $25.00 per change. International packages: $50.00 per change. Groups – Domestic U.S.: $50.00 per change. International: $75.00 per change up until 60 days before travel.
All golf packages will be re-priced when the changes are made, which may result in a price different from the original price. Less than 45 days before travel, changes cannot be made without the approval of WGTC. We cannot accommodate changes to a confirmed itinerary after mailing travel documents (approximately seven days before domestic travel or 21 days before international travel). Depending on individual course policy, changes to the names of golfers may incur a fee for the differences in terms.
REFUNDS: Any refunds due for cancellations by the company will be issued within 60 days.
ENTRY REQUIREMENTS: Passports are required for U.S. citizens when traveling to most international destinations. Passports should be valid for six months upon entry into the country. Visas may also be necessary for some goals; please enquire for more information.
TRAVEL DOCUMENTS: Travel documents will be delivered at least 14 days before departure for domestic travel and 21 days before international travel. Under no circumstances will WGTC release documents without full payment.
AIR TRAVEL: Air travel is not included in your Golf Package(s). Air travel and transportation to your destination are your responsibility.
LOST VOUCHERS: WGTC assumes no liability for lost, misplaced, or stolen tickets/vouchers. If required, a replacement set of coupons will be sent via overnight mail for a charge of $25.00 per delivery (to U.S. addresses only). The passenger is responsible for any cost associated with the subsequent use of lost or stolen vouchers.
RESPONSIBILITY: WGTC, Charlotte, North Carolina, acts solely as an independent contractor licensee and not as an agent, employee, partner, or joint venture of any entity. WGTC acts on behalf of the customer and is not liable for any losses or breaches of contract or any omissions or careless actions on the part of suppliers that may result in any damage, loss, injury, or irregularity to any customers for tours arranged by WGTC. In the absence of gross negligence on their part, WGTC shall not be responsible or liable for any personal injury or property damage, delayed departure, missed carrier connections, lost or damaged luggage, the substitution of service, changes in fares, schedules, or rates by any transportation carrier, hotel, resort or golf course, cancellation, double booking, missed reservations or lost tickets beyond its control. Furthermore, WGTC is not now, and shall not become liable or responsible in any way whatsoever for any loss, injury, or damage caused by acts of God, actions of government or other entities, wars, pandemics, civil disturbances, hijacks, thefts, or any other circumstances beyond its control.
Tour participants should note that the suppliers/vendors providing accommodations or services are independent contractors, not agents or employees of WGTC.
The customer acknowledges these terms by embarking on their travel and voluntarily assumes all risks. All rates in this proposal are valid at the time presented but are subject to change at any time. The tour participant, individually and on behalf of the individual’s heirs, spouse, and beneficiaries, expressly waive any claims of any nature or descriptions against WGTC arising from, or in any way attributable to, golf packages in conjunction with WGTC golf vacation programs.
INSURANCE: You are responsible for, and we strongly recommend you obtain travel insurance to protect yourself to the extent possible. We do not carry and have no obligation to maintain insurance coverage to protect you. We do recommend you obtain a complimentary quote from USTII at 855-874- 0156.
ENTIRE CONTRACT: This is the complete, final, and exclusive binding contract between the parties relating to travel and supersedes all prior agreements, understandings, both written and oral, and may not be amended or altered after your initial deposit has been made except in writing, signed by all parties.
SEVERABILITY: If any provision or portion of any provision is held unenforceable or invalid, the validity and enforceability of the enforceable part of any such conditions shall not be affected.
NOTICES: All notices and communications shall be in writing and shall be mailed first class, faxed, or emailed as follows:

All notices, requests, consents, waivers, approvals, demands, and communications required or permitted under the Agreement must be in writing and shall be deemed to have been duly given upon earliest to occur of (a) when delivered personally by hand to the recipient, (b) when delivered by overnight courier (such as FedEx or UPS), (c) when transmitted by electronic mail with the receipt of such electronic mail being confirmed by telephone, or (d) via first class mail, no later than the business day following the transmission.
CAPTIONS: Captions are for convenience and reference only and shall not constitute a part of this contract or be given any substantive effect.
CONFIDENTIALITY: All information regarding the terms of this Agreement and any Addendum(s) shall be kept confidential. No confidential information of either party shall be disclosed to other parties without the other party’s written consent.
INDEMNIFICATION: To the fullest extent permitted by law, each of the parties shall indemnify, defend and hold the other party (and its respective officers, directors, employees, agents, members, affiliates, and subsidiaries) harmless from and against all claims, damages, losses, and expenses, whether direct, indirect or consequential, including but not limited to all fees of attorneys, court and arbitration costs (whether incurred in preparation for trial or arbitration, at trial or arbitration or on appeal in insolvency proceedings incurred by the indemnitee) as a result of or relating to a breach of any provision of this Agreement by the Indemnitor unless the indemnitee had explicitly approved the act or omission. This provision shall survive the duration of this Agreement.
GOVERNING LAW, DISPUTES, AND ARBITRATION: This contract shall be governed by, and construed in accordance with, the laws of the state of North Carolina, USA. Any dispute, controversy, claim, or complaint between the parties must be resolved by final and binding arbitration by the International Arbitration Rules of the American Arbitration Association through its North Carolina Regional Office unless the parties mutually agree otherwise in writing. Reserving a package and sending the initial deposit is and shall constitute the acceptance and ratification of this contract by you.
EVENT OCCURRENCE AND FORCE MAJEURE: We provide hotel reservations, ground transportation, air travel is provided, and all services from third parties as a travel agent, and not as a principal. If the planned event is postponed, canceled, or relocated due to disaster, Covid, government action, acts of God, strikes or labor unrest (other than by our employees), riot or civil disorder, acts of terrorism, inclement weather, transportation strike, or another event beyond our control not anticipated or known by either you or by us at the time of the purchase of your package(s), our liability, if any, is and shall be limited to providing you with replacement hotel reservations and ground transfers to the next or rescheduled event, with price escalation and adjustment as necessitated by change of date(s), and we shall have no other and further liability to you. Likewise, in the event we arrange air travel or golf tee times we shall have no liability to you should the event not occur when and where scheduled and you choose not to use such purchased services.
By registering for a trip, you acknowledge that you have reviewed and accepted the payment terms of booking a journey with Women’s Golf and Travel. We want this Solheim Cup to be an exceptional experience for you, filled with memories, new friendships and an outstanding overall travel adventure.
